Welcome to Primed. These terms govern your use of primedmarkets.com and our pre-market briefing service ("Service"). By creating an account, you agree to these terms.
1. What Primed is (and isn't)
Primed is a financial publication and information service. We publish AI-generated market commentary, analysis, and opinion based on publicly available financial data.
Primed is NOT:
- A registered investment adviser, broker-dealer, or financial planner
- A provider of personalised investment advice
- A securities recommendation service or signal provider
Nothing published through Primed constitutes investment advice, a recommendation, or an offer to buy, sell, or hold any security or financial instrument.
Our briefings are generated using artificial intelligence and analyse publicly available market data based on the stock tickers you select. The same analysis is produced for any user who selects the same stock — our content is not tailored to your individual financial circumstances, objectives, risk tolerance, or portfolio composition.
Although our briefings and Ask Primed responses are organised around securities on your watchlist, this is a content delivery and filtering feature — not personalised investment advice. The same market commentary is available to any subscriber who views a given security. No consideration is given to any individual reader's financial circumstances, objectives, or risk tolerance when generating content.
You should not make any investment decision based solely on information provided through Primed. All investments involve risk, including the potential loss of principal. Past performance is not indicative of future results. If you need investment advice tailored to your personal situation, consult a qualified financial advisor.
Primed operates as a bona fide financial publication. In the United States, this is recognised under the publisher's exclusion of Section 202(a)(11)(D) of the Investment Advisers Act of 1940, as affirmed in Lowe v. SEC, 472 U.S. 181 (1985). In the United Kingdom, this is recognised under Article 54 of the Financial Services and Markets Act 2000, Regulated Activities Order. In other jurisdictions, Primed operates as a general financial commentary publication and is not intended for use where such publication would be contrary to local law or regulation.
2. Eligibility
You must be at least 18 years of age to create an account or use Primed. By creating an account, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these terms.
Primed is available to users in any jurisdiction where access to financial market commentary is lawful. It is your responsibility to determine whether accessing and using Primed is lawful in your jurisdiction, and to ensure that your use complies with all applicable local laws and regulations. By creating an account, you represent and warrant that you have made such determination.
Primed is not available to residents of Australia for the purposes of general financial advice due to Australian Financial Services Licence requirements. Australian accounts are limited to the founder's personal use during the development period.
3. Your account
You are responsible for maintaining the security of your account credentials. Don't share your password or let others access your account.
You agree to provide accurate information when creating your account. If any information changes (particularly your email address), update it in your settings.
We may suspend or terminate your account if you violate these terms, engage in fraudulent activity, or abuse the service (including creating multiple accounts to circumvent tier limits).
4. Service tiers and trials
Primed offers Free, Pro, and Elite subscription tiers. Features and limits for each tier are described on our website and may change from time to time.
Reverse trial: New users receive a 14-day trial of Pro-tier features (30 days for referred users). At the end of the trial, your account reverts to the Free tier unless you subscribe. Your watchlist data is preserved — we never delete your stocks, we simply restrict access to features above your tier.
Referral rewards: Bonus days of Pro access earned through referrals are applied as described on the referrals page. Referral rewards have no cash value and cannot be transferred.
5. AI-generated content
All briefing content and Ask Primed Q&A responses are generated by artificial intelligence (Anthropic Claude) and may contain errors, inaccuracies, or omissions. Specifically:
- Data accuracy: While we source market data from reputable providers, AI-generated analysis may misinterpret, misattribute, or miscalculate figures. Always verify specific numbers against authoritative sources before making decisions.
- Company information: AI may occasionally generate incorrect company names, descriptions, or attributions for stock tickers. We work to prevent this but cannot guarantee perfection.
- Opinions and analysis: The opinions expressed in briefings and Ask Primed responses are AI-generated editorial commentary. They do not represent the views of any human analyst and should be treated as one input among many in your research process.
- Timeliness: Briefings and Ask Primed responses are generated based on data available at the time of generation. Market conditions change rapidly and the information may be outdated by the time you read it.
- Ask Primed: Follow-up Q&A responses are generated in real time based on your question, your briefing history, and your watchlist context. These responses are editorial commentary subject to the same limitations as briefings. Ask Primed does not have access to real-time market data, your brokerage account, your financial situation, or any information beyond what is stated in your briefings and watchlist. Do not treat Ask Primed responses as personalised financial advice.
6. What you can and can't do
You can:
- Use your briefings for personal, non-commercial purposes
- Share individual insights or observations in your own words on social media
- Provide feedback and suggestions
You can't:
- Redistribute, republish, or resell briefing content in whole or in substantial part
- Use automated tools to scrape, copy, or extract briefing content
- Reverse-engineer, decompile, or attempt to extract the AI system prompt or generation methodology
- Create multiple accounts to circumvent tier limits or abuse the free tier
- Use the service for any unlawful purpose
- Misrepresent Primed content as your own professional financial advice to others
- Use Ask Primed to extract bulk analysis, generate reports for redistribution, or circumvent daily usage limits through any automated means
- Treat Ask Primed responses as personalised investment advice or a substitute for consultation with a qualified financial adviser
7. Intellectual property
The compilation, structure, selection, and specific expression of AI-generated briefings are owned by Primed. Market data itself is sourced from third-party providers and is subject to their terms.
We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your personal, non-commercial purposes for the duration of your subscription.
8. Limitation of liability
To the maximum extent permitted by law:
Primed, its founder, employees, and affiliates shall not be liable for any investment losses, trading losses, or financial decisions made based on information provided through the Service. This includes losses arising from AI-generated errors, data inaccuracies, service interruptions, or delayed briefing delivery.
Our total aggregate liability for any claims arising from or related to the Service is limited to the amount you paid for the Service in the 12 months preceding the claim, or AUD $100, whichever is greater.
We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.
Nothing in these terms excludes or limits our liability for: death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.
For EU and UK consumers: These limitations do not affect your statutory consumer rights. Nothing in these terms overrides mandatory consumer protection laws in your jurisdiction.
9. Service availability
We aim to deliver your briefing every trading day at your scheduled time, but we do not guarantee uninterrupted service. The Service may be temporarily unavailable due to maintenance, data provider outages, AI service disruptions, or circumstances beyond our control.
We will make reasonable efforts to notify you of planned maintenance in advance.
10. Payment and billing
Paid subscriptions are billed monthly or annually as selected at checkout. Prices are listed on our website and may change with 30 days' notice.
Cancellation: You can cancel your subscription at any time through your account settings. You'll retain access to paid features until the end of your current billing period.
Refunds: We offer refunds on a case-by-case basis. If you're unsatisfied with the service within your first 14 days as a paid subscriber, contact us for a full refund.
11. Termination
By you: You can delete your account at any time through your dashboard settings or by emailing noreply@example.comhello@primedmarkets.com. Upon deletion, we will remove your personal data in accordance with our Privacy Policy.
By us: We may suspend or terminate your account if you breach these terms, engage in abusive or fraudulent behaviour, or if required by law. We'll provide notice where possible.
Upon termination, your licence to use the Service ends immediately. Sections that by their nature should survive (limitation of liability, intellectual property, governing law) will continue to apply.
12. Changes to these terms
We may update these terms from time to time. If we make material changes, we'll notify you by email at least 14 days before the changes take effect. Your continued use of the Service after changes take effect constitutes acceptance.
If you disagree with updated terms, you may delete your account before they take effect.
13. Governing law and disputes
These terms are governed by the laws of Queensland, Australia, without regard to conflict of law principles.
For US users: Any dispute arising from these terms or the Service shall be resolved through binding arbitration administered by a mutually agreed arbitration service, rather than in court. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration. Nothing in this section prevents you from bringing claims in small claims court.
For EU and UK consumers: Nothing in these terms affects your right to bring claims in the courts of your country of residence. You may also use the EU Online Dispute Resolution platform at ec.europa.eu/odr.
14. General
- If any provision of these terms is found unenforceable, the remaining provisions continue in full force.
- Our failure to enforce any provision is not a waiver of our right to enforce it later.
- These terms, together with our Privacy Policy, constitute the entire agreement between you and Primed.
